Definitions

Devices are defined as end-user devices, like PCs, Smart Phones, TVs etc.  Connecting with a server is not allowed, and might lead to termination of the service.  If there is a need to connect servers to the InMotion service, explicit permission must be granted by the Motion Corporation.

Number of devices is defined as the number of unique devices that have connected to the service within the given time limit. When the time limit has passed, the number of devices is reset to 0 for the next period.

Reserved capacity defines the peak number of concurrent devices. I.e. a reserved capacity of 10,000 will guarantee that 10,000 devices can be connected at the same time.  Unused capacity is not transferable to a later time.

Customer is defined as the person or business that uses the InMotion service.

Downtime is defined as the period of time the InMotion service is not available for use due to errors on Motion Corporations end. Issues with the service due to external factors, like firewall rules, network issues or programming errors are not regarded as downtime.

Limitations

The InMotion service must not be used for warfare, terrorism or other ways of purposefully negatively impacting the well being of people or animals. 

The customer is not allowed to resell motion directly without a prior agreement with the Motion Corporation. Using motions in the customers own services and applications is allowed without other restrictions than those mentioned in this document.

If the free service is used, no commercial usage is allowed. It is also compulsory to show the text “Sync by Motion Corporation” easily readable on the service or app. 

The customer is responsible for monitoring the amount of devices that use the service and avoid too many accesses. If too many accesses are performed, the system will fail with a “quota exceeded” error.

Programming libraries

The Motion Corporation provides a set of tools available for users of the InMotion service, such as the Sequencer, MediaSync objects and so forth.  These tools can be freely used by our customers, but the Motion Corporation does not take responsibility for any errors or imperfections of said tools or potential losses due to these.  The tools are available under an LGPL license, and the customer is free to alter them as long as the terms of the license are kept.

Support

Support is provided at an additional feed, according to our standard rates. Reported issues with the InMotion service will be addressed within one working day after the time of reporting. Additional support, such as assistance in how to use the InMotion service, the programming libraries etc is only available through special agreement between the customer and Motion Corporation.

Adjustments of capacity

An increase in capacity can be requested at any time. Payment for the new clients will be calculated from the day of increase. Reducing capacity must be done in writing (via email), and the reduction will take place at the earliest one week after notice. Increased capacity will be billed for at least one month regardless of reductions within that time span.

Termination

The customer can terminate the service at any time, and this will be effective after the end of the following month. For example, terminating the service the 15th of January means that the service will be active until the 1st of March.

Paid fees will not be refunded in case of termination.

Motion Corporation is free to terminate the service if the customer violates the terms and conditions or fails to pay outstanding bills. Termination will be announced electronically to the contact person of the customer and is immediate if not otherwise specified in the contract between the customer and Motion Corporation.
